General Business Terms

Information for consumers long distance sales contract
and customer information for contracts in electronic business

§ 1 Area of applicability

The following General Business Terms in their valid version at the time of order placement are applicable to the business relationships to the customer for orders placed via the Internet shop.

§ 2 Contract conclusion

The illustration of our products on our Internet appearance only includes an invitation to the customer to make an offer for contract.

When the customer places an order on the Internet page of Amazon, he makes an offer pursuant to § 145 BGB for the conclusion of a contract. After sending the order the customer first receives an order receipt confirmation via email.

The contract is concluded if we accept the offer of the customer in writing or in text form within 10 days, or send the ordered goods. If the payment method advance payment is agreed upon we already now declare the acceptance of the contract offer of the customer at the time the customer makes payment in advance, if payment is done within 10 days after sending the order.

§ 3 Expense payment of the regular costs of return shipping if the customer enforces his right to withdraw

You shall pay the regular costs for return shipment if the delivered goods correspond to those ordered and if the price of the object to be returned does not exceed an amount of 40,00 Euros or in case of a higher price of the object if you have not yet provided the counter service or a contractually agreed upon partial payment at the time of withdrawal. Otherwise the return shipment is free of charge for you.

§ 4 Delivery, shipping costs, transfer of risks

Delivery takes place for the shipping costs listed for each single case. If the customer is a consumer we carry the risk of shipping independent of the shipping methods. If the customer is a businessman, all risks and hazards of shipment are transferred to the customer, as soon as the goods are handed over to the contracted logistics partner.

§ 5 Reservation of title

The delivered goods remain our property up to full payment of the purchase price.

§ 6 Payments

The payment methods displayed to the customer in the framework of the order process are accepted.

§ 7 Warranty

The warranty is based on the legal regulations of the Civil Law Code (BGB. If the purchase is a trade business for both business partners, the regulations of the Commercial Code remain untouched.

§ 8 Information for consumers in long distance sales contracts and customer information in contracts in electronic business

We are not subject to special codes of behaviour not listed above.

b)
Possible errors in the entry of your order can be recognized prior to sending the order and corrected with the help of the modification function prior to sending the order.

c)
The essential characteristics of the products we offer as well as if applicable the duration of validity of limited offers are stated in the individual product descriptions in the framework of our offer.

d)
The language available for contract conclusion is exclusively German.

e)
Complaints and warranty claims can be stated to the address listed in the provider identification.

f)
You can save the contract text on your computer by clicking on the right mouse button on the saving function of your browser or print it put using the print button of your browser. You cannot access the contract text. Apart from that you can view the data of your order via your user account under „Where is my order?“. We save the contract text.

g)
Information about payment, delivery or fulfilment is listed in the concrete product offer.

§ 9 Miscellaneous

a)
The Law of the German Federal Republic is applicable to the contract relationship between us and the customer as well as to the respective business terms. If the customer is a consumer, the existing legal regulations and rights according to the law of the country of residence of the customer for the benefit of the customer are untouched by this agreement. The application of the UN Convention on the international sale of goods is excluded.

b)
Exclusive place of jurisdiction is the court of our business residence, insofar the customer is a businessman pursuant to the Commercial Code a legal entity under public law. In this case we have the right to file lawsuits also at the location of the customer.

§ 10 Severability Clause

Should individual clauses of this contract not be legally effective in part or whole or lose their legal effectiveness later on, this has no influence on the validity of the rest of the contract.
